“Smartphone Wars” patent litigation and other matters have thrust standard setting by private standard setting organizations (SSOs) into the forefront of antitrust and intellectual property news. Jeffery Cross, a Partner in the Litigation Practice Group, explores some of the antitrust risks facing an SSO and its members and discusses the steps that an SSO can take to achieve its goals, while reducing the risk of liability, in the article "Standard Setting and Antitrust: SSOs, SEPs, F/RAND and the Patent Holdup." The piece was published in the March 14 issues of the Wolters Kluwer newsletters Antitrust Law Daily and IP Law Daily.
