Cross Writes about Fundamental Antitrust Principles Relating to the Licensing of Intellectual Property

“Care must be taken to consider antitrust laws in imposing restraints on the licensing of intellectual property,” writes Jeffery M. Cross, a member of the Litigation Practice Group and Antitrust & Trade Regulation Group, in an article for the trade publication the Licensing Journal. In his article, Cross explores the tension that has existed historically between the antitrust laws and intellectual property, particularly the patent grant, and writes about how fundamental antitrust principles can be used to determine whether the restraints in a license are lawful. The article, “Antitrust and the Licensing of Intellectual Property: The Application of Basic Antitrust Principles,” was published in the April 2016 issue of the Licensing Journal.
