Automatic Right to Refile Complaints Not So Automatic

The Illinois "saving" statute, which gives plaintiffs additional time to refile complaints that are voluntarily dismissed, does not apply to cases filed under the federal Jones Act. So, a suit against the owner of the Grand Victoria Casino Riverboat, for injuries suffered while serving as a crewmember on the boat, was barred by the three-year limitations period of the Jones Act. Picciotto v. RGB Riverboat, No. 2-00-0425, 2001 WL 865409 (2d Dist. July 30, 2001).
