Forty is Over the Hill

This action was for dissolution of marriage whereby the husband's attorney requested fees and filed a citation to discover assets. Thereafter a lien was issued on the husband's house, which was sold by the sheriff in an execution sale. The circuit court vacated the sale and the purchasers of the house appealed. In the appeal, the husband was appointed a guardian who filed a brief. The guardian's brief contained 40 footnotes, most of which contained arguments and citations to authority. Under Supreme Court Rule 341(a), footnotes should be used sparingly. Therefore the Court held that the guardian's brief violated rule 341(a), and the court granted the purchasers motion to strike the footnotes from the guardian's brief.
