Recovery of Fees For All Counts Based On Common Core of Facts

The U.S. District Court for the Northern District of Illinois allows a prevailing plaintiff to recover fees associated with all counts based on a common core of facts. The court rejected the defendant's argument that the plaintiff should only be allowed to recover fees for time spent prosecuting the count based upon a statute that allowed for the recovery of fees.
