The U.S. Supreme Court announced recently that it will hear three consolidated cases that address whether pension plans maintained by church-affiliated organizations, such as hospitals, are exempt from the Employee Retirement Income Security Act (ERISA). The cases were brought by hospital employees who claimed their employers did not comply with certain ERISA provisions, while the hospitals say the pension plans are not governed by ERISA due to the religious affiliation. David M. Kaufman, a key member of the Healthcare Practice Group, was interviewed by the Society for Human Resource Management (SHRM) for an article that analyzes the cases and addresses implications of prospective rulings.
