We are experienced in representing debtors and trustees – including post-confirmation liquidating trusts – in chapter 7 and 11 bankruptcy cases throughout the Midwest and across the country. With almost 100 years of collective experience, we can quickly and effectively deploy strategies to restructure business operations and finances, or where necessary, to liquidate operating businesses and surplus assets to maximize creditor recoveries. Additionally, in conjunction with our Litigation Practice Group, we can aggressively prosecute litigation claims, including fraudulent transfers, preference, and directors and officers liability claims, to enhance estate distributions.
Recent debtor and trustee representations include:
- Represented a chapter 7 trustee of a Chicago-based meat processing and packaging company as special counsel to prosecute more than $25 million in litigation claims against multiple parties;
- Represented the liquidating trust of a regional bank holding company with more than $7 billion of liabilities;
Represented the post-confirmation creditor trust of a large regional ready-mix cement company, involving the reconciliation of more than $600 million in general unsecured claims and prosecution of claims against the debtor’s former directors and officers for breach of fiduciary duties; and
- Representation of chapter 7 trustee of a national fiberboard manufacturer, involving the disposition of real and personal property in multiple states and the prosecution of more than 100 avoidance actions.
