We have represented parties in dozens of sales governed by section 363 of the U.S. Bankruptcy Code, and are experienced in preparing and negotiating stalking horse and competing bids, negotiating competitive chapter 11 bidding procedures, and conducting and participating in complex bankruptcy auctions.  We have also litigated, on behalf of creditors’ committees and disenfranchised bidders, when sale processes have not been conducted according to the best interests of bankruptcy estates and their creditors.

We are also frequently engaged by opportunistic parties, including private equity funds, to identify and capitalize on distressed acquisition and investment opportunities.
