This webinar will feature an in-depth discussion of non-competes and how to balance a company's economic interests with that of the departing employee's need to earn a living. Non-compete agreements are becoming more common than ever. These agreements can protect the economic interest for companies, but the agreements should also allow departing employees to secure future employment and earn a living subject to some basic and temporary restrictions. The seasoned panel from the ABA Tort Trial and Insurance Practice Section's Business Litigation Committee will discuss best practices and common mistakes in drafting and negotiating such agreements, as well as effective strategies in litigating non-competes.
Specifically, the panel will address a wide array of non-compete issues including:
- Red Pencil vs. Blue Pencil states
- Proper scope and geographic limitations on the agreement and what impact a specific profession or line of work can have on the scope and geographic limitations
- Additional consideration for the agreement beyond continued employment
- Possible consequences of termination with cause as opposed to without cause
- Selective enforcement
