PCB Compliance and Defense

About 10 percent of all polychlorinated biphenyls, commonly known as PCBs, produced since 1929 still remain in the environment. Because of the ubiquity of PCBs, avoidance is nearly impossible, as shown by the fact that the U.S. Food and Drug Administration (FDA) allows for 1.5 ppm of PCBs in milk and 3.0 ppm in oil. Our priority is to help clients mitigate risk and comply with all federal, state, and local PCB standards.

At Freeborn, our environmental attorneys have an in-depth understanding of PCB regulations and the risks relating to them. Our lead environmental Partner, Philip L. Comella, has 30 years of experience in counseling clients in PCB-related legal matters, including those involving disposal requirements, dilution, cleanup standards and coordinated waste approvals.

Clients have included companies in the oil and gas, food, and waste disposal and treatment industries, among others.

Our Environment and Energy Practice Group also has worked on multiple facets of the Comprehensive Environmental Compensation and Liability Act (CERCLA or Superfund ), including preparing rulemaking comments; negotiating amendments to Records of Decision; representing generators, transporters, and site owners against Superfund action orders; and heading up PRP groups.
