Transportation Litigation

With more than 80 attorneys devoted specifically to litigation, Freeborn's Litigation Practice Group brings both bench strength and deep experience to each client matter.

Our litigators are trained, first and foremost, to understand the client's business and their goals. Within the context of those goals, our focus is obtaining the best result possible for the client’s business, whether that is success at trial, mediation, or arbitration or a favorable settlement. Our litigation achievements are based on our knowledge of the litigation process, our ability to efficiently organize and creatively prepare our cases, and our capacity to nimbly adjust course when appropriate. Whether the litigation requires a single lawyer or a team of 20, we are trial-ready lawyers, equipped to provide client-focused results.

While our offices are primarily based in Chicago, since our founding in 1983, we have handled cases nationwide. These cases arise in a variety of subject matter disciplines - from complex antitrust cases to real estate disputes and from reinsurance matters to contract issues. Organized in sub-practice areas, our depth of experience crosses many industries.

Representative transportation matters include:

  • Obtained a preliminary injunction for an inland port developer against a local municipality to prevent closure of certain roads providing access to the facility, using ICCTA preemption, Surface Transportation Assistance Act and Federal Aviation Administration Authorization Act claims.
  • Represented a tier 1 automotive supplier in a dispute with a purchasing company regarding contracts in 37 countries, including issues related to requirement contacts.
  • Represented a Class 1 Railroad, winning summary judgment in an antitrust case involving allegations of Section 1 and Section 2 violations.
  • Represented a national railroad against the insurer of a defunct parts manufacturer with respect to coverage for a multi-million dollar jury verdict for damages sustained as a result of a train derailment.
