7th U.S. Circuit Court of Appeals Hands Victory to Two Canadian Mining Companies Accused of Violating Antitrust Law

The Chicago Daily Law Bulletin reported today that: "The 7th U.S. Circuit Court of Appeals has declined to reconsider a ruling that handed a victory to two Canadian mining companies accused of violating antitrust law in a $500 million lawsuit filed by American purchasers of sulfuric acid."

This decision provides closure to a long-standing dispute in which attorneys from Freeborn & Peters LLP represented the defendants, FalconBridge Ltd. and Noranda Inc.  The earlier decision by the U.S. Court of Appeals, in which it found that the companies did not engage in price fixing when they urged U.S. chemical producers to stop producing sulfuric acid and instead distribute their sulfuric acid, is described here: https://www.freeborn.com/news/us-court-appeals-seventh-circuit-affirms-entry-judgment-sulfuric-acid-antitrust-litigation.

David C. Gustman, a partner and head of the Litigation Practice Group at Freeborn & Peters LLP, argued the case on behalf of the prevailing Canadian companies. Partners Jill Anderson, Jeffery Cross, Andrew Nordahl, Verona (Missy) Sandberg and Associate Tonita Helton also represented the defendants in the matter.
