Asbestos Bench Trial Victory

Freeborn & Peters won a bench trial against infamous asbestos trial lawyer James Walker before Judge Haase in Will County Circuit Court. This case arose out of an award issued against our client, in the amount approximately $588,864, after thirteen years of litigation in a workers compensation claim. The plaintiff elevated the case to the Circuit Court based upon allegations of failing to properly pay the award, plus accumulated interest at 9%, after the death of an employee caused by mesothelioma. If we had lost the case, our client would have had to pay (i) disputed elements of the award; (ii) a significant amount of back interest; and (iii) all legal fees for both this litigation and  the 13 years of past litigation. In addition to finding our client properly paid all amounts owed and denying the plaintiff any money damages, the Court also ruled in favor of our client on three legal issues key to the industry. The case was tried by Michael Scotti, with associate Beth Dolehide and summer associate Gia Fonte providing valuable assistance in preparing for trial.
