Cross Writes about Pre-Litigation Management of Attorney-Client Privilege Issues

The scope of attorney-client privilege is frequently misunderstood, creating issues during litigation that include whether a document is properly withheld under the privilege at the time of production, as well as challenges by the opposing party to that production. In his recent column, Jeffery M. Cross, a member of the Litigation Practice Group and Antitrust & Trade Regulation Group, examines why it is important to give attorney-client privilege thorough consideration before litigation arises to ensure that the clients’ interests reflected in the privilege are fully protected. The article, “Consider Attorney-Client Privilege Before it Becomes a Litigation Issue,” is published in the August-September 2016 issue of Today’s General Counsel magazine and is part of Cross' ongoing series, “The Antitrust Litigator.”
