Freeborn Attorneys for AXA Versicherung AG Concur with Judge's Statement, Ruling Against Baxter International Inc.

An Illinois federal judge has ruled that Baxter International Inc. must hand over communications with a brokerage firm to Freeborn client AXA Versicherung AG because the communications are “not even close” to being covered by attorney-client privilege. The matter is part of the companies’ legal battle concerning coverage for liabilities related to contaminated blood products. John M. O'Bryan, a member of the Litigation Practice Group, was referenced in the Law360 article "Baxter Must Give Brokerage Firm Docs To German Insurer" as deferring to U.S. Magistrate Judge Jeffrey T. Gilbert's statement that “They didn't have a basis for withholding these documents.” The article, published Jan. 25, also mentioned Litigation Practice Group members Joseph T. McCullough IV and Robert M. Baratta, Jr. as representing AXA.
