Ready Or Not, FDA Must Promulgate Rule On Intentional Adulteration Of Food

In the Legislative Update article, which was published on September 3, 2013, to the Food Safety Magazine eDigest, attorney John Shapiro discusses the final schedule for issuance of seven rules that Congress deems to be the foundation of, and framework for, the Food Safety Modernization Act. Therein, Shapiro explains that although the FDA claims it needs at least two additional years in which to formulate, consider comments on and finally publish the intentional adulteration rule, the Court ruled that the FDA no longer may delay absent congressional action.
