On January 4, 2013, Circuit Judge Kathleen Pantle of the Circuit Court of Cook County ordered that the Metropolitan Water Reclamation District of Greater Chicago pay our client, NM Project Company LLC, $36.4 million dollars in damages for delaying construction of the Ritz-Carlton Residences, Chicago, Magnificent Mile for a period of eighteen months. The court had previously ruled that the District had interfered with the client’s easement rights by blocking an alley adjacent to the project site. As the court found, the delay in construction resulted in increased costs and substantial losses for the developer, NM Project Company.
David Gustman, a Firm Partner, served as lead counsel in this case and was quoted in the article as saying, “Although the court didn't award all that we sought, it is a significant award which will help compensate the client for its considerable losses.”
