Richard Kienzler is a commercial litigator and Partner in Freeborn's Chicago office.

In his practice, Rick has tried cases to judgment; drafted appellate briefs; argued and won significant pre-trial motions' deposed key witnesses; negotiated settlements; and conducted internal investigations. He utilizes these skills in a general business practice representing large companies, owner-managed businesses and individuals in state and federal cases across the country, as well as in arbitrations and other proceedings conducted outside of court.

Rick frequently represents clients in disputes concerning non-competition and non-solicitation agreements, and he has extensive experience with fast-paced, emergency proceedings in which parties seek temporary restraining orders and preliminary injunctions. In addition to this expertise, Rick has successfully resolved significant, large-scale commercial contract disputes, partnership and shareholder disputes, and class action lawsuits.

  • Successful six-week bench trial defense of the directors of a community bank against claims that they breached fiduciary duties in approving SBA loans without appropriate underwriting processes and procedures.

  • Successful three-day bench trial defense of real estate developer against an attempt by a home builder to recoup significant earnest money paid to secure exclusive building rights for the final phase of a residential community in the Western Suburbs of Chicago.

  • Past and ongoing representation of clients in the insurance brokerage and pharmaceutical industries in lawsuits concerning post-resignation obligations of departed employees party to employment agreements prohibiting competition, solicitation, and disclosure of trade secrets and confidential information.

  • Successful representation of a Fortune 100 corporation in disputes arising from commercial transactions and relationships.

  • Achieved favorable resolution of multiple class action lawsuits against mortgage servicing company related to debt collection activities performed during the foreclosure process.
