Confidentiality issues frequently rise in mergers between competitors, which will have competitively sensitive information that, if they were to remain competitors, they would not want the other party to know. Jeffery Cross, a member of the Litigation Practice Group and Antitrust & Trade Regulation Group, writes about best practices for protecting that information.
