Freeborn Gets Second, Final Victory for Client

Freeborn’s client, Brown & Brown, Inc., one of the largest insurance brokerage firms in the United States, has emerged victorious after a trial before Judge Castillo in the Federal District Court for the Northern District of Illinois. Besides obtaining a comprehensive permanent injunction against the defendant, the Court awarded Brown & Brown approximately $1.9 million in damages, attorneys’ fees and costs. In addition, the Court referred the defendant and one of defendant’s witnesses to the office of the United States Attorney for investigation of perjury.

The case began during the summer of 2007, when Freeborn & Peters obtained a preliminary injunction against a former employee of Brown & Brown who had solicited the company’s customers and misused confidential information in violation of restrictive covenants.

Freeborn & Peters litigation Partners Michael J. Kelly and James M. Witz tried the case on behalf of Brown & Brown, with the assistance of Partner William N. Krucks and Associates Gia F. Colunga and Matthew J. Kramer.
