Ingram, Stearns and Chibani Write about Insurance Exclusions Affecting Opioids Manufacturers and Distributors

As states, municipalities, counties and cities seek legal recourse against drug manufacturers and distributors concerning the drug companies’ alleged role in the opioids epidemic, at least one recent court case looks to be influential. The successful motion for summary judgment in Travelers Property Casualty Co. v. Anda Inc., Federal Insurance Co. argued that the economic damages West Virginia claimed against wholesale pharmaceutical distributor Anda Inc. did not constitute damage “for” or “because of” bodily injury as required under the applicable CGL policy. Lawrence P. Ingram, Jason P. Stearns and Sarah E. Chibani, members of Freeborn’s Insurance and Reinsurance Industry Team, write about Anda and the impact of products-completed exclusions in insureds’ CGL policies, and how drug companies likely will continue to test legal arguments to invoke insurance coverage relating to the opioids epidemic.
