Litigation Victory on Behalf of Our Client, Oliver-Hoffmann Corporation

Freeborn & Peters LLP had another trial victory in Stefani & Sons Development, Co., Inc., v. Oliver-Hofmann Corp., Case No. 11 L 1169, a breach of contract case brought in DuPage County, Illinois. The plaintiff, a large home builder in the Naperville area sued our client, a Naperville land developer, for breach of contract on a land deal that went bad.  Our client, in turn, filed counterclaims against the home builder for breach of contract.  

While the real estate contracts at issue involved 90 lots worth nearly 12 million dollars, the dispute centered around earnest money paid and due under one of several related contracts.  Freeborn & Peters took the case over from another firm during the middle of the discovery phase.  After thoroughly analyzing the case and claims, Freeborn & Peters asserted counterclaims, completed discovery and prepared the case for trial. 

After a two-day bench trial before the Chief Judge in DuPage County, Freeborn & Peters successfully defended against the breach of contract claims and obtained judgment in favor of our client on its three-count counterclaim.  Not only did this win result in a six-figure sum to the client, it allowed our client to quickly sell the land to another home builder.
