Subway v. Quiznos, or "Meat/No Meat"

When Quiznos embarked upon an aggressive advertising campaign comparing its new cheesesteak sandwich to Subway’s sandwiches, including a contest where consumers created their own videos, Subway sued Quiznos for false advertising and unfair competition. In a novel defense, Quiznos claimed it was not liable for the user-generated videos under the Communications Decency Act, which protects websites such as YouTube from liability. However, in a preliminary ruling, the court denied Quiznos’ defense.
