Two-Year Statute for Legal Malpractice

Legal malpractice cases must be filed "within two years from the time the person bringing the action knew or reasonably should have known of the injury for which damages are sought." 735 ILCS 5/13-214.3.  This is so even though a separate section of Code of Civil Procedure allows five years where there has been fraudulent concealment. 735 ILCS 5/13-215. So said the Illinois Supreme Court recently in a closely watched case, Morris v. Margulis, No. 88685, 2001 WL 812372 (Ill. July 19, 2001).
