Representative Matters
Represented a client in litigation to enforce patent rights relating to an extensive portfolio of radio-frequency identification (“RFID”) patents.
Negotiated licenses with the Collegiate Licensing Company and CAPS (Coalition to Advance the Protection of Sports Logos, which represents the NHL, NFL, MLB and other leagues) in connection with client’s use of professional team names and colors on its products.
Represented a telecommunications manufacturer in patent litigation involving technology directed to the reduction of power consumption in computer processors. (E.D. Tex.)
Represent major sandwich chain in patent litigation; formation of joint defense team with similarly situated defendants in order to lower cost and drive favorable resolution.
Represented a global marketing and promotional agency in relation to legal compliance for online sweepstakes and promotional contests, including viral marketing campaigns using YouTube and other social media.
Representing software company in trade secret misappropriation case in the context of cruise ship guest experience systems.
Defended a foreign vodka manufacturing company in a trademark infringement claim resulting in a settlement that permitted the client to continue to use the name.
Represented a Big 10 University in litigation regarding copyright ownership dispute and trademark infringement relating to the university’s logo and obtained favorable resolution for the client.
For a large national bank, prosecuted a claim against a software vendor for fraud in the sale and delivery of a software product leading to a $3.4 million recovery of licensing fees and other costs.
Represented a leading provider of digital media and online media players in connection with the protection of its trade dress and trademark rights and its online and mainstream advertising campaign for its online music download service.
Successfully used UDRP proceedings to transfer domain names to numerous clients and successfully defended a UDRP proceeding which resulted in a decision that the “Complaint was brought in bad faith and constitutes an abused of the administrative proceeding.”
Represented client with respect to video game copyright, and rights not conveyed, when licensor created a derivative work.
Represented an entity created by a group of leading media companies which provides nationally branded online services in the classified advertising marketplace in connection with co-branding agreements and the acquisition and protection of trade dress and trademark rights.
Tried claims worth over $100 million to a federal jury arising out of defendant’s breach of a technology and patent licensing agreement relating to truck engines. The case settled before closing arguments, resulting in a recovery for our client of multiple millions of dollars (exact amount is confidential at the request of the defendant.)
Representing a large residential services company before in copyright litigation related to the unauthorized use of the client's customer-service manuals in training classes offered by the defendants. (M.D. Tenn.; 6th Cir.)
