Healthcare Practice Group Authors Article on Regulatory Rate Review

2015 marks a significant year for health insurers and the healthcare marketplace as a whole. That's because it was the first opportunity that payers had to compile an entire year's worth of data regarding populations purchasing coverage on the open exchanges created by the passage of the Affordable Care Act. After reviewing this data, many payers decided to up the price of their premiums, in part due to increased healthcare costs. These insurers compiled regulatory rate filings in accordance with the ACA, a relatively new process that has yet to be thoroughly vetted in administrative proceedings or in the courts.

Attorneys Deborah Dorman-Rodriguez, Leader of the Healthcare Practice Group, and David Kaufman, a Partner in the Healthcare Practice Group, recently authored an article on the topic of regulatory rate review for Westlaw Journal Insurance Coverage. Titled "Health Insurance Rate Regulation in the Post-ACA World," the piece provides an overview of the current regulatory rate review process and explores some of the issues that regulatory agencies and the courts have yet to address.
