Partner Marc Zimmerman Provides Commentary for Human Resources Director Article on The Department of Labor’s Proposed Independent Contractor Rule

Freeborn Partner and Leader of the firm's Labor & Employment Practice Group, Marc Zimmerman, recently provided commentary for an Human Resources Director article entitled, "Employers will face ‘heightened scrutiny’ under Biden’s proposed gig rule." The article discusses what HR leaders should know about The Department of Labor's proposed rule that aims to allow for more types of workers to be classified as employees under federal law. The rule would establish a non-exhaustive six step economic realities test for determining whether a worker is an employee or an independent contractor.

According to Marc, "the proposed rule complicates the legal analysis as each non-exhaustive factor represents only an unweighted piece of the puzzle, and therefore will subject employers to heightened scrutiny over worker classification and plainly will prove more difficult for employers to establish a worker’s independent contractor status.” To learn more or read the full article, click here.
